My name is John Burns and I’m a personal injury attorney in South Orange County California. My office is located right where Mission Viejo, Laguna Niguel, San Juan Capistrano all come together.
New Attorney Takes Care of Everything For You.
You just tell the new attorney who you want to hire to advise your prior attorney that the new attorney is taking over your case. The new attorney will send a letter to your prior attorney advising them that he’s taking over your case with your consent and agreement, and the old attorney will relinquish your files to the new attorney.
What Payment is The Prior Attorney Entitled To.
The prior attorney is entitled to a portion of the attorney fees in California, in regard to the amount of work he or she has done on your case. But you don’t have to pay that as an additional attorney fee in California. You have no increased attorney fees.
What happens is at the time of settlement or judgment after a trial, your new attorney must pay a portion of his or her attorney’s fees to the prior attorney in regard to the amount of work the prior attorney did on your case. You are usually not charged extra attorney’s fees so there’s no reason not to change your attorney if you wish to do so.
Should You Talk to Attorney John P. Burns About Taking Over Your Representation?
Now, if you’re in that situation and you’d like to change attorneys, why should you call me to talk about it? The reason is simple. I have no problem in contacting your prior attorney, explaining in a nice polite way that I’m taking over your case with your agreement, and we go ahead and resolve your case with me as your new attorney with no problems in the transition.
I’d like you to call me to talk about this. My phone number is (949) 496-7000, and my email email@example.com. I look forward to hearing from you. Thanks for watching the video. Have a great day.
